Rent Agreement

THIS AGREEMENT WITNESSETH AND IT IS HEREBY AGREED BY AND BETWEEN THE ‘5TH GEN MOTOR TRADE LIMITED’ (Company No. 13578958) AND ‘CUSTOMER’ AS UNDER:

That the hiring of bikes may be done for a minimum period of 1 day.

Bike Rental Procedure
The Customers are expected to gain surety on the dates and bike preferences before booking as the Company takes full and complete payment for the hire period which is non-refundable.
The Customers are vested with an option to make a deposit of 50 GBP for booking the bike they wish to rent so as to avoid any last-minute hassle or unavailability of bikes on the day of hire. Moreover, on the day of picking the bike, that is, the day of hire, they are obligated to make the full payment.
During the collection of bike from your end, the Company shall take a deposit starting from 300 GBP to up to 350 GBP depending on the kind of bike hired and package selected by the Customer.

Criteria for Hire/ Rent Grant
Any hire made with the Company must be done by individuals who are at least 17 years of age.
The Customer is bound to bring any previous criminal records, penalties, fines and/or court proceedings against them to the knowledge of the Company during the procedure of bike renting.
Bikes are forbidden to be used for any ongoing competition, rally, trial, track day, motor-cross, enduro events, performance test, race of trial of speed whether between motor vehicles and/or otherwise
Before releasing the vehicle, the Customer must provide his/her full driving licence, provisional licence and or CBT certificate if applicable and one utility bills to prove your address.
Foreign nationals will be required to also provide passport and proof of where they are staying in the UK.
All driving offences must be declared to the Company prior to hire and must be acceptable to the insurers. Failure to advise us in advance may result in the refusal of hire and loss of rental charge.
The Company cannot supply to anyone with a DR, IN, BA, UT, or DD code on their licence within the last two (2) years. If the Customer has a CD code or any other offence code unsure about, please contact the Company for clarification.
EU travel is available on request (additional charges apply).

Duties and Responsibilities of Customer
Customers need to be aware that they are responsible for theft of the motorcycle on hire to them, any damage, excess tyre wear, tyre damage and punctures.
During the time period of hire, the Customer shall be held responsible for checking engine oil levels and lubricating/ maintaining chain tensions. They must also be responsible for replacing all fuel used.
In any event of a bike being stolen the Customer will lose their deposit in full. They will not be issued with a refund for any time remaining on the hire period and will not be given a replacement bike.
Keys and any accessories must be returned to the Company and/or the Customer will be responsible for further charges to cover the replacement. If the keys are not returned in reasonable time frame, the Customer will be responsible for the entire value of the motorcycle on hire to them.
Customers are responsible for an excess mileage charge, after mileage allowance as stated on hire agreement.

Payments
Payments of relevant figures can only be made by way of debit card, cash, bank transfer and/or credit card. Such payments are taken on a pre authorisation basis, wherein the funds for the deposit are reserved by the Company in case of any damage, theft or charges incurred whilst the bike is in your possession. On signing the hire agreement form you are authorising the Company to debit amount relevant from your card for any additional charges inclusive of but not limited to extended rental periods, damage, late charges, fuel refills, over mileage, punctures or unpaid penalty charges.
The Security Deposit shall be released (can take up to 10 working days) upon receipt of the vehicle in a mint, undamaged and good condition (which is also subject to inspection). If in certain scenarios, the bikes are returned dirty, damaged or defected, full inspection of the bike shall take certain time, hence, the deposit will be returned subsequent to the same counting the extra days it may take.

Refunds and Vouchers
In the event of an accident or vehicle theft during your hire, or should the bike become unusable or un-repairable within your hire period, we offer no full or partial refunds on rentals paid nor a replacement bike.
Upon booking confirmation, no partial and/or full refunds shall be made provided that the bike is returned early, cancelled and/or not collected; (Provided that reasonable wear and tear and loss or damage by fire, flood, rains, accident, irresistible force or act of God excepted).
In the event of an accident, theft or rider error, for say wrong fuel, loss of keys etc, the Customer will be covered with breakdown assistance, however he/she shall be responsible and be charged accordingly for repairs, loss, damage, relay, recovery and or repatriation. The hire period agreed will end at this point with no refund or replacement bike.
Any Gift Vouchers provided by the Company are non-refundable and cannot be exchanged for cash having validity for 1 Year only.

Penalties
The Customer is responsible for the payment of all the fines inclusive of but not limited to speeding tickets, parking fines, congestion charges, toll charges and/or any other chargeable offence arising in the course of rental.
Any penalty charges dealt with the Company shall be incurring an administration charges plus taxes which will be laid in detail during the event of its happening.

Limitation of Liability
The Company hereby limits its liability for any breach of the terms of the Rental Agreement and/or for any other liability arising out of the conditions of the Rental Agreement herein. The Company vests and reiterates its immunity to exclusion of all liability caused by loss of profit, goodwill, contracts and/or by way of any indirect, consequential and/or economic loss.


Governing Law and Jurisdiction
The underlined agreement shall be governed and construed in accordance with the prevailing laws in England and be subject to the jurisdiction of the Courts of England
